Quickertrade Terms & Conditions of Platform Engagement Tools

1. Acceptance of Terms and Conditions

1.1. These Platform Engagement Tools Terms & Conditions (the “Engagement Tools Terms”) outline the rules for using or participating in the platform engagement tools, activities, programs, and related services (collectively referred to as the “Engagement Tools” or “Tools,” with each being a “Tool”) provided by Quickergroup Ltd. (hereafter “Quickergroup”) on Quickergroup’s websites and/or mobile applications (the “Platform”) designed to engage users on the Platform.

1.2. By utilizing any of the Tools, you agree to abide by these Engagement Tools Terms as a User (as defined below). These Engagement Tools Terms are in addition to the Terms of Use and the Terms & Conditions of Sale, which continue to govern your use of the Platform and are incorporated by reference into these Engagement Tools Terms. Definitions and provisions from the Terms of Use will apply to these Engagement Tools Terms unless otherwise defined.

1.3. Each Tool may be subject to specific rules (“Specific Rules”) provided with or accessible through the Tool. If you do not agree to any of the Specific Rules, you should cease using the Tools subject to those Specific Rules.

1.4. In the event of any inconsistency or conflict between documents referenced in these Engagement Tools Terms not explicitly resolved within those documents, the inconsistency or conflict will be resolved in the following descending order of priority: the Specific Rules, the Engagement Tools Terms, the Terms of Use, and the Terms & Conditions of Sale.

2. Tools Conditions

2.1. The Tools are provided solely for personal entertainment and benefit. The use of the Tools for business or commercial purposes is strictly prohibited.

2.2. A “User” refers to you and/or an individual who has installed the Quickergroup mobile app and registered for an account on the Platform. Some Tools may have additional eligibility requirements set forth by Quickergroup at its sole discretion, which will be outlined in the relevant Specific Rules.

2.3. Users are prohibited from using the Tools (including all individual mobile application page interfaces) with any programs other than the designated Quickergroup client program. Prohibited programs include, but are not limited to, automated bots, tools intended to replace or supplement the Quickergroup client program, scripts, and automated programs that provide any User with an advantage over others, such as auto-refresh functions and other integrated browser mechanisms involving automated procedures for using the Tools.

2.4. Users are expressly prohibited from engaging in the following actions:

(i) Creating, exploiting, or using bugs, cheats, mods, hacks, or any third-party software products that alter the results, functions, or gameplay of the Tools.

(ii) Using software for data mining, scraping, or intercepting information related to the Tools.

(iii) Utilizing any rewards (including, but not limited to, virtual items such as Quickergroup Coins, Quickergroup Gems, deals, platform, or brand vouchers) obtained through the Tools for purposes other than purchasing Products on the Platform.

(iv) Buying, selling, or trading customer accounts on the Platform.

(v) Creating and/or using multiple Customer and/or Quickergroup user accounts on the Platform and/or Services.

This includes any actions that circumvent or mirror the above prohibitions.

3. Points, Vouchers, and Rewards

3.1. Points, Vouchers, and/or Rewards earned from participation in any Tools are subject to the Terms & Conditions for Vouchers and are redeemable solely for discounts on Products available on the Quickergroup platform during the specified period and under the conditions established by Quickergroup and/or its partners.

3.2. Points, Vouchers, and/or Rewards not claimed or used within the specified period will expire and become invalid.

3.3. Points, Vouchers, and/or Rewards are non-transferable and cannot be exchanged for cash.

3.4. Points, Vouchers, and/or Rewards are available in limited quantities and are distributed on a first-come, first-served basis while supplies last, unless otherwise indicated by Quickergroup in Specific Rules or other communications.

3.5. Quickergroup reserves the right to cancel any Points and/or Vouchers awarded to a User or Orders made with a Voucher if it is determined that the User has breached any terms, including but not limited to these Engagement Tools Terms, the Terms of Use, Privacy Policy, and/or the Terms & Conditions of Sale.

3.6. Users are responsible for any applicable taxes or charges imposed by tax authorities in relation to amounts payable under this Program. If Quickergroup is legally required to withhold taxes from any amount due or payable to the User, Quickergroup reserves the right to make such withholdings and pay the net amount to the User.

3.7. If an Order is canceled or a Product is returned after Points or Vouchers have expired, the User will receive a refund only for the amount actually paid. Expired Points or Vouchers cannot be refunded or redeemed.

4. Warranties and Liability Limitation

4.1. Quickergroup provides the Tools based on its technical and operational capabilities. The Tools are offered on an ‘as is’ and ‘as available’ basis, subject to the availability, functionality, and reliability of the resources used to provide them, including, but not limited to, the Platform, Quickergroup’s systems, and any relevant third-party tools. This includes potential downtime or unavailability due to technical issues, required maintenance, or events beyond Quickergroup’s reasonable control.

4.2. Quickergroup may, at its discretion and without prior notice, upgrade, modify, suspend, discontinue, or remove any of the Tools. Quickergroup will not be liable for any impact such actions may have on your use of the Platform or your ability to access any Tools. Except as expressly stated in these Engagement Tools Terms or relevant Specific Rules, neither Quickergroup nor its service providers or affiliates offer any warranties (express or implied) regarding the Tools, including their accuracy, availability, reliability, or any associated software or hardware.

4.3. Users agree that Quickergroup will not be liable for any loss, damage, fine, regulatory action, claim, or compensation related to the Tools (collectively referred to as “Liabilities”), including but not limited to: (i) breaches of these Engagement Tools Terms by the User, (ii) any alleged unauthorized transactions, disruptions, errors, defects, or unavailability of the Tools, and (iii) any data loss or damage to software or hardware used by the User to access the Tools, to the fullest extent permitted by law.

4.4. To the extent permitted by law, Quickergroup’s maximum aggregate liability to any User concerning such Liabilities, whether under contract, tort, or other legal theories, shall be limited to £1,500.

4.5. Users acknowledge that some aspects of the Tools are managed by Quickergroup’s partners or third parties. Quickergroup is not responsible for, and will not have Liabilities regarding, any parts of the Tools managed by these third parties. Users release Quickergroup, its officers, board, and employees from any claims or demands for damages, loss, or injury related to the third-party managed sections of the Tools.

5. Content Restrictions

5.1. All content uploaded to the Platform is governed by Quickergroup’s Content Terms of Service.

5.2. The Tools include various content, imagery, media, and graphics protected by trademarks, copyrights, or other rights held by Quickergroup or third parties. Users may not edit, copy, distribute, publicly reproduce, or use any Tool for purposes other than those outlined in these Engagement Tools Terms, unless explicitly permitted by Quickergroup or otherwise agreed upon in writing. Copyright information and brand names must remain unchanged and visible. The term “content” encompasses all data, images, text, graphics, music, sounds, sound sequences, videos, software programs and codes, and any other information provided or developed by Quickergroup or available for download.

5.3. Users must not engage in actions that compromise or disrupt the proper functioning of the Platform, the Tools, or any individual services or functions on the Platform. Users must also refrain from any measures that could lead to unauthorized access to data.

6. User’s Obligations

6.1. Each User agrees to:

(i) Comply with all applicable laws and regulations when using the Tools.

(ii) Adhere to all third-party terms applicable to the Tools, including terms of use, policies, guidelines, and any third-party sharing channel terms used to invite others to use the Tools.

(iii) Be responsible for all information communicated, submitted, or transmitted to Quickergroup or third parties.

(iv) Avoid using the Tools or allowing their use in a way that could negatively impact other Users or the reputation of Quickergroup or its affiliates.

(v) Not participate fraudulently in the Engagement Tools, including using multiple customer accounts, copying others’ entry information, or engaging in any activities detrimental to third parties or Quickergroup. Each User may only participate with a single customer account.

6.2. If Quickergroup discovers or suspects a breach of these Engagement Tools Terms, including fraudulent use of the Tools, Quickergroup reserves the right to:

(i) Investigate the User’s account.

(ii) Prevent, restrict, or suspend the User’s access to the Tools (or any part thereof) or the Platform.

(iii) Deactivate, cancel, delete, or ban any account or access to the Platform and/or Tools, either permanently or temporarily, without notice.

(iv) Report any suspected illegal activities to the relevant authorities and cooperate with them.

(v) Forfeit any Rewards, Points, Vouchers, or benefits obtained through the use of the Tools, including purchases made during such participation.

7. Data Protection, Collection, and Use of Personal Information

7.1. By accessing or using the Tools, you consent to Quickergroup collecting information from you, which may include personal details such as photographs, names, and usernames.

7.2. You consent to Quickergroup using, tracking, consolidating, disclosing, or sharing your personal information with third parties (including affiliates, service providers, and other Users) for purposes including:

(i) Displaying information on the Platform related to the Tools.

(ii) Managing the Tools and any associated rewards.

(iii) Facilitating the use of the Tools.

7.3. The Privacy Policy, as outlined in the Terms of Use, will apply to all personal information collected under these Engagement Tools Terms.

8. Miscellaneous

8.1. Should any provision of these Engagement Tools Terms or any Specific Rules be found to be illegal, invalid, or unenforceable, in whole or in part, it will be amended or removed as necessary to ensure it is legal, valid, and enforceable while reflecting Quickergroup’s original commercial intent. If it is not possible to amend or remove the provision entirely, then the provision, or the affected part, will be deemed excluded from these Engagement Tools Terms or the Specific Rules. The remaining provisions of these Engagement Tools Terms or Specific Rules will continue to be valid and enforceable.

8.2. Quickergroup reserves the exclusive right to modify, add to, or otherwise change these Engagement Tools Terms at any time, as it sees fit. Any changes to these Engagement Tools Terms will be effective immediately upon posting. If you continue to use the Tools after such changes, you agree to be bound by the revised Engagement Tools Terms and will be considered to have accepted the changes.

8.3. Quickergroup’s decisions regarding all matters related to the Tools will be final and binding on all Users.
